. CONDITION GENERAL OF THE CONTRACT OF LEASE OF THE VEHICLE
1.1. Fiscal and Artificial identity.

1.2. description of the nature of the service and their recruiting.
Globalia Automobiles CO.LTD. develops a mercantile activity dedicated to the rent of vehicles without driver for a minimum period of 2 hours and a maximum of 90 days inside the Spanish territory, using the commercial mark “pepecar.com” and lending this service as much with own vehicles as with non own vehicles but in agreement with other operators, guaranteeing that for it these they have all the authorizations y/o permits that are mandatory.



The present General Conditions of Reservation have prevalencia order, what means that they will be able to be complementary y/o modified by the conditions peculiar of each service; whenever the rent vehicle is property of an operator third or abide to specific conditions of a certain promotion. For it, the user (from now on, the contracting party), he/she commits to read the applicable particular conditions to each service, previously to the application and use of the same one.



Globalia Automobiles CO.LTD. publishes its offer of services and rates through the page Web www.pepecar.com, the net of authorized travel agencies, the line of phone sale 807.41.42.43 (Cost Máx. 1,20 €/min IVA included from fixed telefónia; 1,51€ IVA included from mobile telephony) or through mercantile contracts among Globalia Automobiles CO.LTD. with other companies or collaborators.



Globalia Automobiles CO.LTD. doesn't become responsible for the damages that could be derived of all those technical incidences that affect to the net of Internet, to the access or the same electronic apparatus from which the reservation is made and that they could affect somehow to the realization of the same one (understanding each other as technical incidences, to I title informative and not limitative: interferences, omissions, interruptions, virus computer specialist, mishaps y/o desconexiones in the operative operation of this electronic system or in the apparatuses and the users' computer teams, etc.). In those cases that the incidence was located in the gangplank of payments, Globalia Automobiles CO.LTD. declines the responsibility of the transaction on the financial entity that negotiates the same one.



The client, on the other hand, is responsible for checking her contract once formalized the reservation to put in knowledge of Globalia Automobiles CO.LTD. the possible incidences that could have been produced during the recruiting process in order to pay them without damage of the parts.





1.3. confidential treatment of Data.
The politics of protection of data of Globalia Automobiles S.L. it is welcomed to the legal mark that dictates the Organic Law 15/1999, of December 13, of Protection of Data of Personal Character.

1.4. Artificial and Fiscal responsibility of the contracting party.
For general term, it is considered contracting to the physical person that figures as first driver in the rent contract. In the particular case that the recruiting carries out it an artificial entity (like a company or association) this entity assumes all the nominative and legal responsibility of the ownership of the contract. Without damage of the assumption on the part of the regular drivers of the damages that could cause Globalia Automobiles CO.LTD. or third; either for damages and infractions in those that can incur, either for negligence in the use of the vehicles or nonfulfillment of some of the terms marked in the present Conditions General y/o peculiar of the contract.



The contracting party, during the reservation process through the page web www.pepecar.com, it will consign the data of the ownership of the invoice in the case that you/they don't coincide with the data of the holder of the contract. Of not making consist in the process of reservation fiscal data of company, the invoice will be emitted by defect with the first regular driver's data. In the event of not making consist the data of the invoice correctly in the moment of the reservation, he/she will be able to request the correction or modification of the invoice data by means of the shipment from an electronic mail to [email protected] or phonely calling at the 807.41.42.43 (Cost Máx. 1,20 €/min IVA included from fixed telephony; 1,51€ IVA included from mobile telephony). The application of modification of invoice data will be negotiated by Globalia Automobiles, S.L. in a term of non inferior time to 30 natural days.



The contracting party commits to complete all the terms and conditions picked up in this document, and to inform from its forced execution to all and each one of the additional drivers that you/they figure in the contract.





1.5. requirements for the recruiting.
Minimum requirements for all and each one of the drivers: FOR VEHICLES OF FOUR WHEELS: a minimum year of antiquity of the permission of driving mandatory and in vigor, besides a minimum age of twenty-three (23) years.



FOR VEHICLES OF TWO WHEELS: a minimum year of antiquity of the permission of driving in the case of being regular of the permission type A1 or of three years in the case of being regular of the permission of driving type B1 or equivalent in the case of non community countries; besides a minimum age of twenty-three (23) years.



The celebration of the present contract won't be been able to take to term in case some of the drivers included in him had had more than two accidents with damages own or other people's superiors to a thousand five hundred Eurus (1.500€); he/she had been moved away the permission of driving in the last year or it had been fined or stopped to drive under the influence of the alcohol y/o narcotics in the last year.



It is indispensable requirement to pick up the vehicle to present in vigor the whole pertinent documentation of the drivers that is detailed below, as well as the card of original credit with which the reservation was made (except agreements peculiar of Globalia Automobiles CO.LTD. with third).





1.6. truthfulness and Surrender of Data.
The contracting party, by means of the realization of the contract, confirms that its data and those of the rest of drivers in him reflected they are true.



In the event of falsehood of some of the data or the contracting party to have facilitated uncertain information that gives place to erroneous interpretations, Globalia Automobiles CO.LTD. will be able to solve the present contract, and it won't be forced to rembolsar the paid amount, neither partially neither in their entirety. Also, the total or partial reduction of the frank (extra covering of damages) hired he/she will stop to have validity being the exposed contracting party to a limitless responsibility in front of third and in front of Globalia Automobiles CO.LTD..



The contracting party, regular driver and the additional drivers authorize Globalia Automobiles CO.LTD. to include their personal data in the respective files, as well as it stops their use and automated treatment or not, for the administration and registration of the operations subscribed among the parts. Also, they authorize equally, to the margin of the contractual relationship, the treatment of their personal data for the shipment of commercial offers and publicity for any means (correspondence, telephone, fax, mailing or any other one half telematic), own or of third, by Globalia Automobiles CO.LTD.. The contracting party and the additional drivers authorize Globalia Automobiles CO.LTD. to give their data to the direct linked societies or indirectly with Globalia Automobiles CO.LTD. and, especially, to the companies of the Managerial Group Globalia, to that belongs with the purpose of which their personal data are treated by the same ones, and to be able to send them publicity and commercial, own offers or of third. If the contracting party or some of the drivers wants to consent, to rectify or to cancel their data in all it with respect to the Organic Law 15/1999, of December 13, of Protection of Data of Personal Character, it can go for letter to Globalia Automobiles S.L., C / Seeded Enrique, Nº 6, Building TO, Pozuelo of Alarcón (Madrid 28224), or for fax to the number 91.559.70.33, or for e-mail to the address: atenció[email protected].





1.7. limitations of the Service
The contracting regular conductive y/o commits to conserve in the vehicle a copy of the lease contract during the whole period of rent. In the same way that they commit to inform Globalia Automobiles CO.LTD., or to the service of attendance in highway in the event of having been hired, on any detected mishap or damage suffered by the vehicle that impedes their perfect operation in the same moment in that this happened. In the event of mishap or delivery of substitution vehicle, Globalia Automobiles CO.LTD. or the service of attendance will provide to the contracting regular conductive y/o when giving him the vehicle indications of how to proceed in such a case.



The contracting regular conductive y/o won't carry out itineraries with the vehicle that you/they require its transport in other such means as ferries or trains. The contracting regular conductive y/o commits to not going out with the vehicle outside of the Spanish national territory, Andorra and Gibraltar. You sobreentiende that those cars rented in the peninsula won't be able to leave this. Therefore they won't be able to be transported to Balearic, Canarias, Ceuta, Melilla, neither to the foreigner. Also, the cars rented in islands won't be able to be transported outside of the island in that you/they have been rented.



It is specifically forbidden to sublet the vehicle in everything or partly. The contracting regular conductive y/o is responsible, individual and collectively that any driver that doesn't figure in the contract drives the vehicle.



The contracting regular conductive y/o commits to not using the vehicle in case that its conduction could not be safe. You prohíbe that the vehicle is overloaded neither transport inflammable or dangerous material. It is also rigorously disapproven the use of the vehicle for competitions of any nature, neither to tow neither to push to other vehicles.



The contracting regular conductive y/o, they commit to not using the vehicles like advertising support, with any type of external rotulación that is not that of pepecar included in the vehicle, without expressed authorization (in writing) of Globalia Automobiles S.L. in the event of nonfulfillment, Globalia Automobiles S.L. it will apply the corresponding penalización (to see Annexed, Square of Additional Positions and other possible extras).



The contracting regular conductive y/o commits to that the vehicle is not driven by roads neither not paved surfaces, in the same way that he/she commits to protect the vehicle against meteorological agents that could cause him damages.



The contracting regular conductive y/o commits to not making a negligent use of the vehicle, of which is derived a damage in the security and operation, as blows in the first floor, etc. (to see annexed, Square of Damages and Frank). The derived damages of these uses in any case will be covered for the insurance, even in the case of having hired the extra excuse of frank.



The contracting regular conductive y/o will be responsible solidariamente that the vehicle is not driven under the effects of alcoholic drinks or any other substance that it affected to the capacity to drive, neither it will allow no other driver to make it.



The contracting regular conductive y/o puts under an obligation to return the vehicle hired to the same base from where it was picked up (to see annexed, Square of Damages and Frank).

The pepemoto is a capable vehicle to circulate for the city and its surroundings, one won't be able to leave the community of Madrid, neither of the county of Barcelona. Outside of these limits, pepecar won't give covering of any type, being the responsible client in the entirety of expenses that can be derived of the non execution of this clause (to see Square of Damages and Penalizaciones).

The client that rents a pepemoto commits to make an appropriate use of the vehicle, what implies the following commitments:

- It won't overcome the maximum of daily kilometraje settled down in their contract.

- Independently of the total days of the rent, in the event of surpassing the 500 kms, the basic levels of the vehicle will be revised (it oils and coolant).

- This administration will be able to be coordinated through our Service of Attention to the Client that will give the pertinent instructions.

In the event of not fulfilling these requirements, the company will be authorized to charge the quantities settled down in the annexes, square of damages and frank, respectively, in concept of repair of the damages caused GLOBALIA AUTOMOBILES, S.L.



1.8. politics of collections.
The formalization of the contract is carried out in the same moment of the confirmation of the service, of the acceptance on the part of the contracting party of the conditions established y/o of its payment.

The price of the rent includes according to effective and public rates in www.pepecar.com in the moment of the recruiting (except in specific commercial agreements of Globalia Automobiles S.L. with other companies or collaborators):

-rent of the vehicle, included IVA (IGIC included in Islands Canarias).

-position for preparation.

-discounts y/o overcharges on it tariffs published (if it proceeds) according to the hour of collection and he/she surrenders of the vehicle.

Extra -covering of damages with frank (for details, to consult Politics of damages).

-Kilometraje a hundred (100) kilometers for natural day of rent.

-the collection and the refund is in the same base in that it is hired.

Regarding the type by day of application in the calculation of the rate, the duration of the contract as well as of the extras or hired supplements, they will be counted to effects of natural days for recruitings from www.pepecar.com (except in specific commercial agreements of Globalia Automobiles S.L. with other companies or collaborators). TO contract effects between the client and Globalia Automobiles CO.LTD. every day of rent it begins when opening of the base in which the service has been hired and it finishes when closing of the same one, excepting contracts whose duration is inferior to one day.

Globalia Automobiles, CO.LTD. offers the possibility to its client of being able to not hire a series of extras included in the initial price of the rent in the moment of the recruiting or by means of the modification of the contract through the sale channels described in the present General Conditions, before the beginning of the service or in the moment of the collection of the vehicle, except the cancellation option (according to effective and public rates in www.pepecar.com in the moment of the recruiting [except in specific commercial agreements of Globalia Automobiles S.L. with other companies or collaborators])

These extras not included in the initial price of the rent they are:

- Extra covering of damages: total or partial excuse of the frank included by defect in contract (to consult Square of Damages for rate details and service and specific exclusions of this covering).

-Kilometraje extra: In case the contracting party wants to hire an allowed kilometraje of up to 500 Km. for natural day of rent, he/she will pay an extra quantity for day of rent according to rate in vigor (except in specific commercial agreements of Globalia Automobiles S.L. with other companies or collaborators, in those that this kilometraje is already included).

-Kit of Ski: subject to readiness.

-seat of Baby: subject to readiness.

-option of Cancellation (you can only hire in the moment of the recruiting and not later on): he/she Gives right to the refund of 95% of the total paid in the moment to make effective the recruiting if it is canceled before the beginning of the hired service.

-attendance in highway: If the contracting party chooses the option of attendance in highway, it accepts and he/she understands that this attendance is not limitless, but rather it is subject to some parameters that are detailed under the particular conditions you annex in the section.

-helmet of Protection of Obligatory Use for Law for drivers of motorcycles. Optional recruiting in the rent of motorcycles of 125cc., if the contracting party didn't have a Helmet of Protection in property.

Given the telematic nature of the recruiting, Globalia Automobiles CO.LTD. doesn't accept cash in any case money for its payment. The positions in recruiting through the Web (via Internet directly, via phone, via Internet in agency or in the base) they cover:

The amount of the rent of the vehicle.

The position for preparation.

The option of 100 Km. /día.

Optionally in recruitings made by the previously mentioned roads one will be able to hire:

Maximum Kilometraje of 500 km. /día.

Extra covering of damages (it includes the attendance in highway)–except in the rent of motorcycles, in those that this option is not available -

Attendance in highway.

The cancellation option.

Other extras that are available and depending on the vehicle type that is hired (ski kit, baby's seat ..etc) they will be paid with credit card (the one accepted in each case) in vigor and of ownership of the contracting party in the same moment of the recruiting or, in exceptional cases in that third contracting parties mediate, in the moment of the collection of the vehicle.

Positions in recruiting through the program Week-End Plan of Trips Hawk and Ecuador will be paid with the checks Week-End Plan in the moment of the collection of the vehicle and they cover:

The rent of the vehicle (that includes 500 Km. a day for defect).

Attendance in highway (in Week End Plan is included in all the contracts).

Obligatorily in all the contracts Week-End Plan was carried out by means of payment with credit trajeta (the one accepted in each case) the client's ownership and in vigor, an unique position in preparation concept and cleaning of 10 Eurus.

Optionally in recruitings made through Week End Plan one will be able to hire, by means of payment with credit card (the one accepted in each case) the client's ownership and in vigor:

The cancellation option.

Extra covering of damages (it includes the attendance in highway)–except in the rent of Motorcycles, Industrial Vehicles and Minibús (8/9 squares), in those that this option is not available.

Other extras that are available and depending on the vehicle type that is hired.

Positions in recruiting through other nets of agencies, cover: the rent of the vehicle with the supplements included by defect or hired in each case. It will be paid in the moment from the recruiting to the same agency expendedora. To the collection of the vehicle the client will present a contract or number of contract reference as voucher of the payment.

The contracting party will facilitate to the personnel of Globalia Automobiles CO.LTD.. in the moment of the collection of the vehicle, the credit card (indispensable requirement). Globalia Automobiles CO.LTD. will load a quantity of eighty (80) Eurus in deposit concept against this card to execute if proceeds: such supplementary positions as damages non insureds, extra kilometraje, delay in the refund, or refund of the vehicle in place different from the one assigned or other penalizaciones (to see annexed, Square of Damages and Frank). In the case of not incurring in additional positions and whenever the vehicle doesn't present damages, the amount of the deposit will be paid to the same card entirely, after concluding the period of rent, in the term of time that enables the entity financial agent of the payments and refunds.

In case the vehicle is returned with damages, Globalia Automobiles CO.LTD. won't return the amount of the deposit and it will also load against the card of the contracting party the value of the damages, abiding to the values published under these General Conditions according to that specified in the annex that contemplates the Square of Damages and Frank y/o in its case, the difference until covering the entirety of the generated supplementary position.

To the collection of the vehicle the mandatory collection contract will be sent, which will be signed by the main driver accepting the general conditions of the service and for the holder of the card, if it was different, accepting the payment conditions, refund y/o collection (what proceeds in each case) of the amount of the deposit, as well as of the overcharges (damages y/o delay in the refund if takes place) that corresponded in the moment of the refund of the vehicle.



1.9. guarantee of Service
Globalia Automobiles CO.LTD. commits to give a vehicle in perfect conduction state and security. In the event of eventualities that forced to give a vehicle that was not suitable for their conduction, or there are not available vehicles, Globalia Automobiles CO.LTD. will inform the client of this situation and it will provide to the contracting party, insofar as possible, a vehicle of same substitution or superior or in its defect, to proceed to the refund of all the paid quantities.




1.10. cancellations and Non collection of the vehicle on the part of the client.
The client has the possibility to hire a cancellation option whose amount is published in the offer of available supplements in the Web or in other commercial agreements signed with third. In the event of cancellation when the client has hired the extra option of cancellation, Globalia Automobiles, S.L. you/he/she will return to the contracting party 95% of the total amount of the same one, provided I/you/he/she is canceled before the collection of the vehicle in the facilities of Globalia Automobiles CO.LTD. (in the case of the conditions peculiar of operators third a minimum period is contemplated for the cancellation of 24 hours for the vehicles standard and of 48 hours for the monovolumenes and industrial vehicles).

The cancellation will be able to be carried out through electronic mail to the department of attention to the client of Globalia Automobiles S.L., [email protected], (it won't be effective until the reception of the confirmation in writing), calling to the telephone number 807.41.42.43 (Cost Máx. 1,20 €/min IVA included from fixed telephony; 1,51€ IVA included from mobile telephony), or going to the travel agency in the case of having hired the service through agency. In the event of cancellations of the service via mail a minimum period is contemplated for the cancellation of 24 hours to the margin of the specific conditions of cancellation in rents in bases of operators third.

In the event of not having hired the client this cancellation option, Globalia Automobiles CO.LTD. it won't reimburse quantity some in the event of cancellation or non collection of the vehicle (to exception that for recruiting by means of commercial agreement with third, the contract in particular contemplates exceptions).

The form of proceeding for modifications on the original contract, is by means of the telephone number 807.41.42.43 (Cost Máx. 1,20 €/min IVA included from fixed telephony; 1,51€ IVA included from mobile telephony), or by means of the travel agency with the one that had hired. In the case of recruiting through the program Week-End Plan of Trips Hawk and Ecuador, it must only proceed through the mentioned phone line or an agency of Trips Hawk and Ecuador.
