ACCC freezes bank account of alleged international
pyramide scheme.
The Australian Competition and Consumer Commission last week decide to continue order from the Federal Court, to freeze the funds in Worldplay Limited's FBME bank account over an alleged pyramide scheme.
On 10 March 2005 the ACCC instituted legal proceedings against Worldplay Limited alleging it engaged in misleading and deceptive conduct and other contraventions of the Trade Practices Act 1974 in connection with the supply of internet gaming.
The ACCC alleges that Worldplay Limited by Worlgamesinc has been operating an illegal pyramide scheme from two locations, London in England, Torontola in British Virgin Islands.
The 'freeze order' was the first step in the proceedings and Worldplay Limited has not yet had the opportunity to contest the ACCC's claims in court.
The alleged pyramide scheme came to the ACCC's attention in late 2004 when it received a number of complaints.
In pursing its investigation the ACCC obtained evidence and information from various Worldgamesinc customers and the ACCC's international (US Federal Trade Commission) and domestic (NSW Office of Fair Trading) counterparts.
The ACCC alleges Worldplay Limited by Worldgamesinc has been misleading Commonwealth's business consumers into believing that their investments are safe and their virtual shares actually can be changed in shares of LSE company, which is tecnically impossibel and illegal by Act from 1904.
The ACCC sought a order from the court on the basis that the funds which Worldplay Limited has in FBME should be frozen pending the ACCC pursing an action to obtain compensation for those Worldplay Limited and Worldgamesinc business consumers which have suffered loss as a consequence of Worldplay Limited's conduct.
In this regard, the ACCC invites any company or customer which believes it has been misled by Worldplay limited or Worldgamesinc, to contact its InfoCentre on 1300 302 502.
The ACCC is seeking a range of other orders against Worldplay Limited and Worldgamesinc, which is the operating name of pyramide scheme's netsite, including injunctions, declarations, findings of fact, compensation and various non-punitive orders.
The matter has been listed for a directions hearing before Justice Jacobson in the Federal Court, Sydney, on 17 Mai 2005.
